Notice on the Complaint Procedure

PREAMBLE

  • Swiss jurisdiction shall apply to any and all disputes that may arise in connection with and as a consequence of the activities carried out by Helvetian Guarantee Institute (hereinafter referred to as the “Company”);
  • foreign jurisdiction shall apply solely with respect to the interpretation of certain products and services of the Company;
  • in the event of a dispute arising between the parties and the Company concerning the interpretation and application of any contract, the parties may, prior to bringing proceedings before the competent judicial authority, make use of the Company’s amicable dispute resolution procedures by submitting a specific complaint request form by registered mail addressed to the Complaints Office at the Company’s registered office.

 

The Complaints Office, which may also rely on external professionals, shall respond to the complainant within sixty (60) days from receipt of the complaint.

It remains understood and unaffected that both the parties and the Company retain the right to refer the matter to the competent judicial authority at any time, including while the aforementioned complaint procedure is pending.
